🚫 14 Types of Lands Where Fard Intekhaab is NOT Issued in J&K:
1. 🏛️ Ownership Under L.B.-6 and S-432
Lands allotted to the Tiller under LB-6 and ownership provided under S-432 are protected by government policies for agricultural purposes only. They cannot be sold freely, so Fard Intekhaab is not issued to avoid illegal transfers.
2. 📜 Ownership Under Agrarian Reform Act Sections 6, 7, and 12
Land ownership granted under these sections carries restrictions on sale. Issuing a Fard would violate agrarian reforms, so the revenue authorities do not allow it.
3. ⏳ Ownership Under Section 4 and 8 — Less Than 15 Years
4. ⚖️ Lands Involved in Court Disputes
If any court case (civil, revenue, or criminal) is pending on the land, its status remains unclear. Until full court judgment, Fard Abstracts are withheld.
5. 🌿 Lands under Section 20-B of Big Landed Estates Abolition Act
Community and pasture lands like jaar and arak are protected environmental assets. Issuing Fard for such lands is strictly prohibited by law.
6. 🏗️ Lands Under Acquisition Proposals
If the government plans to acquire land for public purposes (roads, projects), the Fard Intekhaab is automatically frozen during proposal or acquisition stages.
7. 🏦 Mortgaged Lands with Financial Institutions
If land is mortgaged with banks or lenders, full ownership rights are suspended. Thus, Fard cannot be freshly issued unless the mortgage is cleared.
8. ⚠️ Lands Which Are Not Encumbrance-Free
If any dues, liens, or burdens exist on the land, it is not clean. Only encumbrance-free properties qualify for Fard issuance.
9. 📄 Lands Not in Vendor’s Legitimate Share (Khasra/Khewat)
If the seller’s claim is missing or incorrect in official records (Khasra number/Khewat), the land cannot be processed for a Fard Abstract.
10. 🤝 Lands Jointly Owned without Full Shareholder Consent
In joint ownership cases, unless every co-owner agrees in writing, the revenue department will not issue Fard Intekhaab.
11. 🌊 Lands Like Khad, Road, Dariya, Nallah
Natural landscapes such as rivers, khads, roads, and nallahs are protected by the J&K Water Resources Act, 2010. These are prohibited by order of High Court of J&K and Government.
12. 🚫 Lands Violating Section 133-1(A) of the Land Revenue Act
If agricultural land is being illegally fragmented into colonies, issuance of Fard is blocked to protect food security and natural ecology.
13. ⚠️ Ownership Under L.B.-66 of 2000
If ownership acquired by DP of 1971 of state land under LB66 of 2000, then there is prohibition on alienation of this land.
14. 🏛️ Ownership Under L.B.-202 of 2007
If ownership acquired of state land under LB-202 of 2007, then there is prohibition on alienation of this land.
